Problem Regarding E-filling ER-1

Dear sir,

We have problem regarding E-Filling Return Form ER-1,The problem is 1.The tariff notification number/serial number of the notification you have entered does not exists in the database- and we have entered in the file the no. as 2/2008 C.E. and Serial number (1).

2.Non-Tariff Notification number entered by the user is not exists in the database- and we have entered in the file of return as 002/2008 CE(NT) and N.T.. Notification Sl.No.(55).

So our question is that which is correct Tariff Notification no. and Sl.No. and Non Tariff Notification no. and Sl.No.

We are manufacturer of pvc wires and cables and aaac conductors which falls under the CETSH No.85441190 and 76149000. So please reply for these all problems at your earliest....... Thanks

Notification Sl.No.(30). So our question is that which is correct Tariff Notification no. and Sl.No. and Non Tariff Notification no. and Sl.No. We are manufacturer of Pet Bottles which falls under the CETSH No.39235090. So please reply for these all problems at your earliest.......

Pl. suggest the solution.

@ both

if you are paying duty without any condition then no such notification required,

if you are paying duty with some conditional exemption / abatement, then please share the mode, as for a single entry its not possible to track the whole 16 years notifications.

at the time of filing return when u enter the goods manufactured and cleared, select EXPORT /LUT and then proceed on

return will never ask you for the notification number for this export as duty and other details are not required for this clearance, but at the end of return, Export invoice details are required.

If you are paying normal excise duty then there is no need to mention notification no. with sl no..

But if you are availing certain notification wheter under duty payment or without duty payment then as per my point of view correct notification with sl no. should be mentioned. If it does not exist in the database of ACES then he ask only " the notification you entered does not exists in database, do you Continue" then please click yes and retrun will be filed esially. It will help also in the time of excise audit under the impression that you have not suppressed anything with the department.

002/2008 is a notification which limited the tax liability upto 16% and when the basic rate came to 10% this notification is not in existance.

however department officers insist for 002/2008, and despite of error, you can submit the return with 002/2008 C.E.

Thanks for the reply.

I m trying to fill the return but not success. that is my first (Nil) return. our inspector give me above notification no. 002/2008 C.E.(N.T.) for non tariff.

i fill above for non tariff & 002/2008 C.E. for tariff. (in all 3 coloumns- Cenvat, Ed. Cess & H.Ed.Cess.)

our Sr. no. is 67.

but have not success in fill all return.

our CETSH No. is-87088000 & 87089900

for NIL return, you can not fill anything

for returns having old balance, such notification is valid in Basic duty only , not for EC or S&HEC

it will display error, as notification is not valid, simply ignore it and go forward.

So our question is that which is correct Tariff Notification no. and Sl.No. and Non Tariff Notification no. and Sl.No.

We are manufacturer of Organic Clour Dyes which falls under the CETSH No.32041990 and 38099190. So please reply for these all problems at your earliest....... Thank
