Hey guys i wud request u 2 pls participate and give some gud paper presentation tips. Specially i want to know how to answer caselaws in DT-IDT and  que based on pratical stituations i.e case study type ques in LAW n AUDIT...Also i wud really b oblidged if u share some other gud tips for presentation in any paper.

Requesting for more n more suggestions.. All ur suggestions are really welcomed as dey all wud b invaluable :-) :-) :-)

I too wanna knw mainly for dt, idt n isca..presentation style of answers n how to score gud in these subjects..If anyone knws then pls post ur suggestions here..

In DT and IDT, try to remember the names of all the recent case laws that are published by Icai for every exam. In subject like IDT, at times even around 50% of the questions are based only on these recent case laws and amendments. So its very beneficial to learn the recent case laws very very nicely.

But PLEASE NOTE- In a case law based questions, If you are unable to recall or you are not confirm about the EXACT name of the case then dont dare to quote the wrong name of the case law because doing so will get you straight zero even when you have correctly described the judgement.

 

So in such case where you are not sure about the name of a case but you remember the judgement then just write like this- "In a recent case, it was held by the Supreme court/High Court/Tribunal that....".

 

And if you are not even sure that if it was high court or supreme court then just write like this- "As per a recent judicial pronuncment...." (Dont mention Supreme court/High Court/Tribunal if you are not sure).

 

And if you know the name of the case then start your answer giving the reference of the case like this- "The facts of the given case are similar to the case of National Thermal Power Co. Ltd, in which the supreme court held that......."

In such case law based questions, divide your answer in 2 or 3 paragraph.

In 1st para, give the reference case law if you know.

In 2nd para, discuss about the facts of the case.

And in 3rd para give the conclusion to your answer.

Always remember that quoting a wrong name of case law or quoting a wrong section is very dangerous and you could end up getting 0 even for a perfectly correct solution because of this blunder. So do take care of this.

Hey here I wud lyk 2 knw whether v hv 2 quote only name in case of case law or entire refrence

Bhavik, even i am helpless about Audit and law. Since past two attempts i am unable to clear 1st group because of Audit and Law. Though i cleared 2nd group in May12. No matter how best i write these two papers, I am unable to score more than 40-45 in audit and law. I am unable to make out my mistakes. I saw the answers given in practise manual of law but the answers given in practise manual is too lengthy and if i attempt to write answers in such great detail then i am sure, i will not be able to finish the entire paper. Even i am scared of these theory papers.

While answering questions on papers based on Law, it is suitable to support your answers with relevant sections, wherever necessary. Suppose, a student is unable to remember or is confused with the relevant provision while answering, they must abstain from citing wrong section and rather strengthen their answer by appropriate reasoning and examples.

The ICAI material on Select case laws for direct & indirect taxes and RTP is an important source where the paper setter could scout while preparing the question paper, implying that it is imperative on the part of students to make that extra effort to go through these materials religiously.

It is important to take cognizance of facts while answering case law based questions, to structure them in a diligent manner.  While answering case law based questions, it is advisable not to give your absolute answer with a Yes or No in the beginning itself.  This will curtail the chances of the examiner to peruse your entire writing, however factually you may have written the answer. Therefore, it is better to give your conclusions at the end, rather than create a wrong impression at the outset.

 

Structure the answers mainly into 3 parts, Firstly a small gist of the background of the case, Secondly about the facts of the case encompassed with the legal position by quoting relevant provision and case law and finally conclusion based on the facts and decisions of the honorable courts.

It is enough for a student to quote only the case law per se and not required to give the full citation “CIT v. Triveni Engg. & Industries Ltd. (2012) 343 ITR 245 (Delhi)”. If you are not sure of the court which has delivered the judgment, you can simply state “On this issue, recently the Honorable Court held ………………………………………………………………………………”. The usage of prefix to any court judgment with the word “Honorable”, is more professional.

The presentation of answers in the examination has to be meticulous and well structured with legible handwriting to create a good impression to the examiner.

Sathishji ur tips are invaluable indeed..I wud really request u to give some more suggestions..Also i wud like to knw that in case of sfm wen v quote any formula is it necessary on our part to also state what the alphabets in formula stands for?

For eg.: a=b*c; where b stand for so n so n c stands for so n so..

Let me pen down my experiences -

Paper 8- IDT - November 2009 (New Course)

We had about 5 numerical problems and about 6 case laws. 

Where did I go Wrong - In each of the numericals, I treated atleast one adjustment wrongly. End result being the final answer was wrong in each of numericals. 

In none of the case laws i quoted the case reference (I could not remember any). The answers were in my own language. The approach was describing relevant provision then its applicablity to the case and final conclusion. 

After the exam I was quite disheartened as i was under the impression that i messed up with about 60% of the Paper and I was just praying to get passing marks in this subject. The notion being that you have to do everything right and perfect to score marks in CA exams.

January 17 - The D day -

The first glance i had was at my IDT marks  and to my surprise I had scored 70. Later I had a look at the suggested answers and realised the following -

 - I was given marks for the numericals to the extent they were correct. I did not lose much marks here. It would have been step wise marking. 

- Even though I had not mentioned the reference to case laws, I would have been awarded atleast 4 marks out of 6 for the correct answer. 

 

So it is always advisable to give quality answers and to the point. Dont beat around the bush. You dont have to be perfect in everything. Even if you manage to attempt about 85-90 % of the paper fairly, there would be no worries.

Presentation is a way a student communicate his idea with the examiner.

There is a wise saying that “First Impression is a best Impression”.

The valuer will judge you within 5 to 10 minutes by referring your answer sheet; if you start badly it will create negative impression in the mind of examiner and finally unexpected marks.

This means your hard work will be useless if you fail to present the answers up to the mark of examiner. It is your duty to communicate the answer in a better manner.

Easy question first write leave tough At last. You are required to start with the question that you feel more confidence and leave space for unknown questions which will be taken care only during the last hours of the exam only. This can create a good impression with the examiner.

“Bad presentation with Good preparation before exam also Cause failure” Be taking extra care. Always think how you can write more effectively in the examination. Presentation is an art and everybody must practise that art.

Presentation here means writing points in a particular order and in a manner which is easily get the immediate attention of the examiner at the time of valuation. Better to avoid essay type writing I had seen suggested answer and the answer is given in an essay format.

Some students may be thinking that if writing more can score. It is not correct and fair. Drawback of essay type presentation If you have written an answer in an essay format, examiner is required to check all the relevant point throughout the answer book.

This type of approach may be good for your Graduation and other course. Better write your answer in a point to point manner. What is the question, give exact answer in the precise form? If you adopt the below strategy in your exam, then it will have a better effect in your exam Some Rule for better presentation

1. Try to write your answer in your words with the concepts that you had captured in your brain. This means copy and paste answers required to be avoided to the extent possible. For that you should have a firm Grip over concepts and logics.

2. Break the essay format in to the point wise format. Avoid the explanatory points and make your points Precise.

3. Try to give a clear and good heading for the major points. The points shall highlight the major content of the points.

4. Give a Clear margin number for each of your points and Sub point’s numbers .

5. Try to add your own points hitting the concepts along with points

 

6. Give a good conclusion wherever it is necessary.
