we are doing business with a company C&f agent .The company will give Trade schemes to purchase of units to dealers.For that Trade scheme The company has deducted TDS and debited in my account.Now in my TDS certificates the Total Trade scheme will be reflected as Commission.So pls suggest me that i have to pay service tax on that amount or not?
The Total Trade scheme is RS:32,19,500.00

Dear Vijay,
Sorry but I culdn't exactly make out from the facts u have mentioned...
I feell U r an independent Dealer and working with some Clearing & Forwarding Co..That co gives u 32,19,500/- as commission..Further Co. deducts TDS on the entire amount of Rs. 32,19,500/-..
I feel u have to pay service tax on the Commission..But u can avail the Rs. 10 Lacs as exemption if ur last year receipts were less than Rs. 10 Lacs..
