from May 2007 to march 2008 we have received around 60 lakhs as commisiion from C&F Business.
We have service tax registration and we claim it from the company as well @ 12.36% on the bill value but we have not deposited a single ruppee till yet

You will have to pay the service tax @ 12.36%
Inteerst @ 13% will also be charged for not making payment of Ser tax on Time
Penalty u/s 76/78 may be imposed.

sir i am cargo service provider and i just want to know about the srvice tax weather service tax applicable when goods has been booked from Jammu to all over india and payment term is collected from jammu only on TO BE BILLED but party not paying the service tax at the time of freight payment.apart from that party at jammu said service tax is not applicable in jammu on outgoing consignment
plz hep me sir this is very urgent

IAM DOING AS SUB CONTRACTOR IN ERRECTION ,FABRICATION & MECHANICAL WORKS ALREADY MAIN CONTRACTOR COLLECTING THE SERVICE TAX FROM THE CLIANTS AND PAYING THE SERVICE TAX. THE SUB CONTRACTOR IS LIABLE FOR SERVICE TAX OR NOT. AND WHAT IS THE PERSENTAGE OF TAX TO COLLECT FROM THE MAIN CONTRACTOR.
THERE IS NO CLARIFICATION SUB CONTRACTOR FOR MECHANICAL WAS LIABLE TO COLLECT THE SERVICE TAX. SO KINDLY CLARIFY MY DOUBTS IMMEDIATELY

Would like to Know, is RBI as a customer is exempt from Service Tax or not? In short, if we are providing any service to RBI, we need to charge Service Tax to them or not?

Even a sub-contractor is also a service provider under service tax. Any bill raised by you on the contractor needs to be raised with service tax if you have exceeded the overall limit of Rs.10 lacs for registration in the current year. The contractor would be able to set off the credit of the service tax raised in your bills from the amount to be deposited out of his collections from the clients.
He would be paying the balance
as regards the rate of tax, need to understand the details of your operations as regards only service or including service which would form the basis for utilising the options under the service tax act
