there is penalty for non registration if person liable to register of Rs. 10000 or 100% of tax due which ever is higer.

it's under section 122(2), for any other reason.
Becasue we not get gst registration and we are liable to pay gst. so, any punishment only penality

As per my opinion, 100% penalty of tax due(minimum 10000). yes prosecution is also available on high value. let say within one year you liablity is 100-200 lacs then upto 1 year. as like that. other conditions are available.
