can depatment levy penality for late filling of gstr 10, without issuing notice to assessee??

Yes...... its already there in Act , kindly Refer Section 47 of CGST Act
5000/- is for per Act , hence it's maximum 10000( CGST +SGSTt)
100rs per day (50+50)
maximum of (5k + 5k)
