10 April 2013Company has paid membership fees on behalf of director and in the name of director.
Should company consider it as a perk and deduct tds while deducting tds from remuneration ???
Or
Company can consider it as a business expenditure and claim as a deduction ????
if the membership is for companies benefit like membership in chmabers of commerce etc then it shall be treated as busniess expenses and deductible under section 37(1).
In any other case the same shall be treated as perq which is thus added to directors remuneration and TDS is chargeable accordingly..
