Nri status

DEAR ALL,

My Client is a indian citizen , but he is doing some business in overseas, but his visa is under employment category. he come and go , here and there. most of the days he is in overseas and monthly few days in india.

Can I declare him as NRI?

If the following conditions(both)are not satisfied then consider as Non resident:
1.must be present in India for a period of 182 days or more during the previous year.
2.must be present in India for a period of 60 days or more during the previous year AND 365 days are more during the 4 years immediately preceding the previous year.
