Notice under 143(1)(a). what to respond.

I have received a notice under 143(1)(a). This is for a difference in income as under 26as and the filed returns. The difference is due to section 10 deduction which is reflected in Form 16. My numbers are tallying and so I would like to respond under "Disagree".

The following are the reasons for difference.

In Form 16 under Section 10, the following have been deducted -  - 1) HRA, 2) Fuel Reimbursement 3) Telephone expenses reimbursement 4) Children education allowance and 5) Conveyance allowance.

I could respond for 1),4) and 5) in the online response form. I cant find under which sections i need to mention 2) and 3) above. Rest are clearly specified.

Need professional help please.

Telephone charges reimbursement..... Sec. 17(2)(viii) read with Rule 3(7)(ix) of IT act. Refer:  taxability-of-telephone-reimbursement

Fuel Reimbursement........ Sec. 17(2)(viii)  read with Rule 3(2) of IT act. Refer:  taxability-of-fuel-expense-reimbursement
 

Claim under option 'Others'.

Also, you can opt to send out your reconciliation between Form 26AS and Form 16 to the Department manually, along with your ITR and Notice received.

There is reimbursement for fuel expenses and telephone expenses. Even if you payforessay which is work related that can be included in the Others section too. So, do not worry and disagree with the tax file you have received.

How to respond to notice received under section 143(1)

  • If details provided by you in your tax return are verified by the Income Tax department and no discrepancies are found then the notice will serve as the final assessment of the return. All you need to do is to take a print out of the notice and keep it safe with your tax-related documents.
  • If you are getting a refund, wait for the cheque or direct transfer of cash into your account.
