Notice pay recovered -when left within 1 week of joining

Hi,

 

I joined a company on July 4th, and due to some very personal reasons, i had to quit within one week. the company releived me immediately, but they asked me to give notice pay for 27 days, which was the full amount of  my monthly salary, not the basic.

Can the compant take such a huge notice pay, when considering that i did not earn a single rupee from the company, not even one months salary. I was not part of any project also. should the notice pay be based on the basic amount?\

And if at all i have to pay that, this should be included in the form16 from employer, right? But the company is not willing to include this in form 16 as my negative income.

How can I challenge the company's decision.

it is advisable to give 27 day notice salary without wasting time fight against company ,in that time you can find better job
