Mr. X was in abroad for more than 10 years. He came to India on January 2009. As per basic conditions Mr. X satisfied one of the basic condition and he is "Resident but Not Ordinarily Resident". For how much time he will be "Resident but Not Ordinarily Resident".

AS PER ME MR X IS NON RESIDENT IN THIS CASE AS FOR RESIDENT ANY ONE OUT OF TWO CONDITION MUST BE SATISFY ie EITHER 1) IN PREVIOUS YEAR HIS STAY SHUID BE MORE THEN 182 DAYS OR 2) 60 DAYS AND ALSO IN PREVIOUS 4 YEAR HE HAS STAYED FOR 365 DAYS. IN GIVEN CONDITION AS X ARRIVED IN INDIA IN JAN NONE OF THE CONDITION IS FULFILLED SO HE IS NON RESIDENT.
