one of my oms purchaser is not issuing the C Form, hence i have to pay the tax with penalty. Is there any way to avoid the tax liability and fine imposed by Sales Tax Department.

You can charge the buyer with the normal rates of tax on VAT instead of charging him 2%. The VAT u collect from him can be deposited with the govt.
