partnership is a seperate entity from partners.   so,  here the liability of a partner cannot be set off against the partnership assets.    it is also possible to set off through book adjustment,  say partner pay only Rs 5000 to the anubhav and set off the book debt by transfering to parter account showing withdrawel from firm.

hi frnz,

for Q2: Answer:As per section3 of the indian stamp act 1899 no stamp duty shall be chargeable in respect of any instrument executed by, or on behalf of, or in favour of, the government; in cases where the government would be liable to pay the stamp duty.
As per the provisions no stamp duty is payable by the government, hence abhay's contention will not succeed.
