I borrowed 4 lacs rs to Hemant shah, in 2012 by official Cash by official Cash in my clear shown in IT.
I got order also by IT.
Hemant Shah gave me cheque in 2013 but returned.
I went to court by 138. his advocate says, You casaed in the name of Niyati offset proprietor name shailesh parikh.
so give me guidance for laws & right of proprietor.

You will have to refer clause under proprietorship act, where it is specified....... that the proprietor is liable for all the liabilities of the proprietorship concern; similarly he is beneficiary of all the assets of the concern; even after its dissolution.
Better to take professional help from experience advocate in such matter.
