I have booked a flat in chennai in Dec 2009 and registered my flat on 4th March 2010. The completion of the flat is on May 2010. My builder is demanding service tax from me now. Should i pay the tax or will i be exempted from the service tax as the bill is not passed in the parliament yet ? Grateful if any one can advise.

Presumably you have paid the entire consideration. In my opinion there is no liability now or in future as per Circular 108 of 2009 which is in line with the law. Further the amendment which would be applicable from a notifed date in my view would not effect you since the falt is completed and your payments for the same have already been made to the builder. |
