Hi Sir,

 

My wife is a teacher in private school and getting salary Rs. 8000/- per month. But school in not giving her any form 16 / no salary slips. Salary is credited in bank. Please let me know how to file her return and also she is having some tution income where to show this income.

Please suggest

Income from salary would be :12*8000=96000/- (assuming that no conveyance allowance given. in absence of other information, net salary is taken as income)

Income from Business/ profession (tutions): xxx 

income from other sources: xxx bank interest etc

If the total amount exceeds 2L, then file ITR 4.(Give 80C, 80D, 80TTA deductions to the extent applicable)

Kindly note school is not under statutory obligation to issue form 16 in the absence of tax deduction at source. Form 16 is a certificate of tax deduction at source and is not a salary certificate. This is a common misconception.

But yes, salary slip must be given.

You can ask for salary certificate from School at the end of every financial year.. Dear Madhavi he can show tuition income as other income n can file Itr 1....?

Madhavi i didnt get u about ur ITR 4 Advise. According to me assesse can file ITR 1 or 2 easily vis a vis ITR 4. (If tutions are not running as a huge level of business/profession)

But Madhavi when opted for other income in itr 1 system ask for TDS form for the tution income.

Tutions on a small scale can be shown as IFOS (ITR 1/2 can be used.) But in the stricter sense of the term, Tutions are PGBP. This issue has been discussed at length on caclubindia forum many times and experts have opined that Tutions are PGBP.

Mr Vipul, There is no need for TDS certificate for either salary/ Tutions. But, if you are facing this problem, try downloading another ITR1 utility or fill ITR 1 online (this is easier)

Also, pl post the exact error message you are getting.

thanks for advice Madhvi. Please let me know PGDB means and second thing I m not getting any error but IFOR head has caption "esure to fill sch tds2" thats why i am asking.

please suggest.

 

PGBP= profits and gains from business and profession.

automatic messages are generated in the excel utility such as 'fill proper details in TDs sch or verify self asst tax paid' etc. Just click on Ok. I hope you have verified the  26AS form to check the tax credit.(if any)

Yes there is no 26as form under her pan number. Actually I am using new online java ereturn utility. One more thing can IFOS be more than salary for itr 1.
