In recent past, we have ordered and got dispatch of the materials from the supplier(interstate). Mean time we faced some shortfall of storage space, hence we requested the transporter to hold/keep the materials in his place. 

Now we need the materials but the transporter unable to deliver as the original waybill is expired. So how can we proceed? Can we raise a Delivery Challan(being a purchaser) and raise new waybill based on DC? Or is there any other way to get the materials?

This is a common challenge when the original eWay Bill (EWB) validity expires before the goods reach the destination or get delivered.

Key points about expired eWay Bills and movement of goods:

  1. Validity of E-Way Bill:

    • An eWay Bill is generally valid for 1 day for every 100 km (or part thereof) from the date of generation.

    • If the goods are not delivered within this period, the EWB expires and cannot be used for movement.

  2. What to do if EWB expires while goods are with transporter?

    • The transporter cannot deliver the goods as per law without a valid eWay Bill.

    • The goods cannot be moved further or delivered on an expired eWay Bill.

  3. Possible solutions:

    • Option 1: Generate a new eWay Bill for the movement of goods from the transporter’s place to your location.

      • Since the goods are already with the transporter, you (the recipient) can raise a Delivery Challan (DC) to document the movement from the transporter’s place to your premises.

      • Based on this DC, you can generate a new eWay Bill for the onward movement.

    • Option 2: Ask the supplier to cancel the original eWay Bill (if possible) and raise a fresh supply with a new eWay Bill — but usually, once the goods are dispatched, cancellation may not be feasible or allowed.

  4. Documentation:

    • As the purchaser, prepare a Delivery Challan specifying the goods being moved from the transporter’s warehouse to your premises.

    • Generate a new eWay Bill in your name for this movement based on the DC.

    • Transporter can then deliver goods against this valid eWay Bill.

  5. Note:

    • Always ensure to generate eWay Bills timely to avoid expiry.

    • Movement of goods without valid eWay Bill is an offence and may attract penalties.
