Please guide me for below given query:
We had executed Supplemental Memorandum of Deposits of Title Deeds cum exetension on 04/08/2011. The same was registered with ROC within a Time period.
Later on it was found that one property was left out to be mentioned in the said Deed executed on 04/08/2011. The Left out Property has aleardy been given as security to the Bank vide Memorandum of Agreement for extension of Equitable Mortgage dated 31/05/2010 and the same was registered with ROC.
However the same was left to be mentioned in Supplemental Memorandum of Deposits of Title Deeds cum exetension on 04/08/2011.
Now we want to rectify the error and want to execute the Rectification deed as of date wherein we are confirming that we have deposited the title deeds pertaining to the above described property and confirm and consent the Bank to have and to hold and continue to hold and retain as and by way of mortgage by deposit of title deeds, the title deeds in respect of the property described in detail in theMemorandum of Agreement for Extension of Equitable Mortgage dated 31.05.2010, as security for the repayment of all monies or any money that is already due to the Bank or may become due to the Bank hereafter on account of whatsoever business transaction between the Bank and the Company.
Now i want to know whether for filing such rectification deed with ROC, is it necessary to apply CLB or is it enough to file directly with ROC only?
