Hi,
1. Recipient would not be eligible to claim ITC since the last date to avail ITC is the due date of filing return for the month of Sep of next FY or due date to file Annual return for the relevant year whichever is earlier. The above said time limit is already over.
2. Service provider can discharge the liability along with applicable interest @ 18% through DRC-03 and keep the records to substantiate in case of any future notices from Dept.
