Your query is not very clear. However if person has not consented u/s 5 than you can not charge someone u/s 5 with liability.

thanks. query is that person not given consent. what to be done now.
should he asked to resign? is it logical when he not accept appointment ? or simply should paper be filed canceling appointment. pls advise.
