An articled assistant shall earn at the rate of one-sixth of the period for which he has actually served, excluding from such period, the period for which he has been on leave subject to a maximum of 180 days.
eg 1. If we have worked for 120 days we are eligible for 20 days of leave (120*1/6)
eg 2. If we have completed 120 days of articleship but taken 30 days of study leave we are eligible for 15 days leave (120-30*1/6)
what am trying to clarify (referring to eg 2) is whether this 1/6th of actual period served is besides/ in addition to the 182 days (mentioned on pcc prospectus) given to pcc students for studies. As the exact words are 'excluding from such period the period for which he has been on leave'.
The 1/6th of actual period served should be calculated as foll.
365*3.5 = 1278 Days,
less 182 days of study leave as per prospectus ,
= 1096 Days (actual period served)
additional leave = 1096*1/6 = 183 Days (now this 183 Days is subject to 180 Days sealing limit)
