The Formula for Leave allowed is as below.
Leave Allowed = [Total Period Served(Including Leave) - Actual Leave taken during articleship] / 6.
I will explain this with the help of my own example.
Total period of articleship was 1096 days. Actual Leave taken was 180 days.
So leave allowed = (1096-180)/6 = 152 Approx.
But i have actually taken 180 days, i.e. 28 days extension.
So ideally, if you dont want extension, the leave should be 156 days at the maximum. With 156 days leave, the extension comes to Zero.

hey srivatsan how can we take benefit if our principal allows?
is it ki we just explain him this rule of 35 hours and ask him to reduce leave so taken by the hours we overworked ?

The benefit of over-time can be availed by reducing the time overworked from the leave taken. Say if your normal working hours per day are 8. and you have a total of 80 hours of over-time, worked during articleship. So, you can reduce the overtime of 80 hours i.e. to say 8 days (80 divided by 8 hrs per day). If leave taken is say 120 days, you can show it as 110 days, as you have worked for 80 hours over and above the regular time.

hello..... sir i have a problem.. fsrt i appoint as an article clerk to sandeep bakilwal & co. then i terminate the article ship by transfer. my tarnning priod is 27 oct. to 10 sept. 2007........ n this period i have taken 60days leave but as per ICAI rule only can get 43 leave. so i have taken excess 17 days leave. now what can i do

Mr. Girish,
First of all i will suggest you not yo use the name of your firm in any blog of forum. Second thing, the the extension or otherwise is not calculated on principal to principal basis. it is calculated at the end of the training period i.e. 3 years / 3-1/2 years whichever is applicable. So no question of calculating the excess leave on account to transfer.

i have a question
whether a student will be allowed to sit in pcc xam if he take 5 months of leave in his 18 months of articleship..?

Ya, he will be allowed to appear the exam. Any excess leave taken during the articleship period has to be completed after the completion of the original period of articleship, i.e. 3 yrs or 3-1/2 yrs whichever is applicable.
