12 April 2016Dear All, Our client falls under the category of Small Service Provider with no service tax liability to be collected & paid. We filed his service tax returns late. We wish to know is there any penalty or late fee payable for such late filing of return ?

As per the law, you have to pay the penalty depending on number of days delayed. But if the service tax liability is nil, then the department can waive off the penalty subject to propre business reason for such delay.
