Dear All, We are register manufacturer, if labour contracts work in our premises and issu labour bill ie. 15,00,000/- per year

ie monthly 1,00,000/- or 120000/- they are unregister in GST so we have to pay GST. but is there any law to refund it or set of in GST? Please sugges me..

Bcoz., You ll be pay GST under RCM after you can reverse that paided amount. Then What is your query Mr. Suresh Patil...?

*Some points to be carefully considered post GST*

We have never bothered to look into the expenses side of the profit and loss account with respect to earlier taxes. The time has come to make sure, all your payments above Rs. 5000 per day, are paid with GST.

In other words, if you are dealing with unregistered suppliers and making payments above Rs. 5000, you have to pay GST under reverse charge mechanism (RCM).

Salary and wages
Electricity
Interest
Car fuel
Government Fees

*Inclusions:*
Rent
Commission payments
Printing and stationery
Repairs and Maintenance
Office Maintenance
Vehicle maintenance
Computer maintenance
Legal Fees
Consultancy Fees
Professional Fees
Audit Fees
Labour charges
Frieght and transportation expenses
Gift expenses
Business promotion expenses
Advertisement etc..

But the notification for exemption of 5000/ - per day is issued by centre only. States should also pass the same notification. Till than how can we prevent RCM from SGST.??
PLEASE REPLY IF ANYONE HAS ANY VIEW UPON IT.

Govt can't give all the details in briefly. We have studied and select/assume the law points that's all. If somebody wants circular or notifications or proof or reference... they ll be wait and watch the government's reply....
