there is an assessee having business of truck carriage whose books are required are to be tax audit for f/y 2008-2009.....and his books for f/y 2007-2008 are not required to be audited ........and for f/y 2006-2007 his books are tax audited.....so my question is whether he is required to deduct tax on freight paid to outsiders for f/y 2008-2009..because he has not deduct any tds on freight paid to outsiders .....

Accd to me, the person liable to deduct TDS on payment only if he was tax audited in previous financial year. in u'r case, in f.y. 2007-08, the assessee was not liable to tax audit hence he is not liable to deduct TDS in f.y. 2008-09.
