Dear Sir, One of my client is having duel income, first he work in private sector where he drawn salary around 15-16 k where as he has side business of mobile/ dth recharge from where he earn 1-1.5 k per month so gross income is round abount 2.1 L. Now he wants to file a IT return for F.Y 14-15 & 15-16.

So which form should be use.As he is earning both type ( Salary & Business income)

 Secondly he is working with very small private business where PT is not deducted. Nor he file PT on self. So while filing return PT problem will arise ?

i have already ask for PT registration.

Your client has to file ITR 4

PT means Professional Tax ,right? It is state subject and enacted by some states so Income tax department does not consider that.Even in some states Professional tax is prevailing but implementation is not there.

And yes you can file ITR 4 to show both kind of income as already has been replied.

It is not mandatory that he needs to be file income tax return as his income not exceed 2,50,000/- So he is not liable to pay tax but if he wants to declare his income then he needs to be file ITR-4 as Salary & Business income...

ITR 4S - if incase the assessee's business income is computed on presumptive basis.

ITR-4 - in any other cases.
