My friend have got Notice for filling of Income tax return for F.Y. 2009 - 10

he have Business of Transportation. In that financial Year His turnover was near about 15 lakh as per 26AS Statement.

and TDS has been Deducted of Rs 19000/-

So My Query is shall He have liable to paid service tax . . . on given Service

Please reply as early as possible

Your quiry is not clear as u stated that your friend has received notice form IT dept and asking apllicability of service tax. There is no connection between in your query.

No boss you' r friend is not liable for service tax as .....in case of transportaion business service tax liablity is on Service receipient ( reverse charge under GTA service). so not to worry.

Income tax office has nothing to do with this,

no no My friend Got Notice for Filling Income tax return & in Financial Year 2009 - 10 his turn over near about 15 Lakh

& he dont have service tax Registration as well , so if we file Income tax then is there any chance to raise Service tax notice as he have turn over above 10 lakh . . .

but it will be advisable to take service tax no. fo filling of return they will not ask service tax no. but in future if service tax department corealte the data then it may be harmful to you.
