Itr claim in case of double taxation

Hello,

I was in Poland for 10 months in Poland i.e. from December to October last year, so as per IT rule I was NRI, This was my employers first international assignemt and comapny did not got in to checking reagding ITR rules due to unknown reason.

Now the case is, I was getting salary in India, and after all investment proof submission my empoyer deducted Rs. 20000 as iincome tax on my salary income.

In Poland we used to get Per Diem from our customer (In cash,we did not signed any receipt), But still they deducted Income tax at there finanicial year end on global income, charged Income tax was around Rs. 54000.00 (conversion to INR).

So in my case double taxation is happened, So how the ITR should be processed. What amount should I claim.

you need to use ITR-2 to claim credit for taxes on bouble taxed income. 

You can cliam relief for double taxation as per section 90(where India as DTAA with that country) and section 91(where India does not have DTAA with that country)
