ITC SETOFF QUERRY

Input: Cgst - 200, Sgst - 200

Output: Igst-300, Cgst-150, Sgst- 150

In this situation whether cgst input can be used first with with Cgst or Igst.

As per new rule CGST output shall set-off first from IGST , but portal is not working accordingly , it's setting off on old rule ie CGST output will set-off Against CGST input

As per Section 49 of the CGST Act 2017, it is CGST.

But as per Section 49A of the CGST ( AMENDMENT ) Act 2018, it is IGST. But at present, the portal is not functioning as per new rule.

pankaj sir in above casee there is no igst input..then we can utilise cgst input first to Cgst and balance input to Igst liability .

same applicable for Sgst

Means, when IGST Carry forward then new rule is applicable to first setoff with cgst and sgst.

When igst lability then rule is same as old. Cgst first setoff with cgst if amount carry forward than setoff with igst otherwise paid in cash.
