Itc refund

Dear experts,

Sir we are a developer firm.We dont need to pay GST on our sale as it is exempted under GST.

We pay GST on our purchase so our ITC remained unutilized.

Now can we claim refund for this?

No ITC is not to be refunded. As per section 54 of CGST act 2017, refund of itc is only when you engage in export of goods or service or incase of Inverted ITC case. As your supply is exempted yoy can't further enjoy itc Refund.

- No. Refund not available if exempted supplies.

there are two part of service we do.before receiving clearance certificate we need to pay GST and after receiving clearance certificate we don't need to pay any GST as it is exempted. We have claimed all our ITC before receiving Clearance certificate.Now in this case what is the rule?
