Hi All,

This is regarding a query on HRA Exemption. I have left the organisation in Jan 2013 and  in full & final settlement,  lumpsum amount of tax is deducted. the reason being non submission of rental receipts in time. so in F&F, the organiastion has deducted tax without considering the HRA exemption. so the same HRA exemption has not been reflected in Form 16.

Now while filing the return, can i take HRA exemption and claim refund ? In such case, any documentary evidence has to be submitted or not?

If   your organisation has deducted tax with out considering HRA. You can claim deduction under sec 80gg up to 24000.

Yes Mr.Sharath you can claim HRA based on your Rental Receipts subject to other compliances under the ACT. Form 16 is for the employer to give the details of TDS made and basis for the TDS and it is not your return of Income submitted to the Department. Hence you can claim your eligible deductions and allowances in your return even though the same is not considered in your Form 16.

 

However incase there is excess TDS you will have to claim Refund. With respect to Documentary evidence, you need not submit anything for filing the Return, you wil have to submit those only if the Income Tax Officer asks for it.
