20 July 2009One of my collegues couldn't file IT return for AY 2008-09. She has income from salary and has no outstanding taxes to be paid.
1. Does she need to submit a penalty of Rs 5000?
2. Can she e-file the above return? If yes how does she pay the penalty of Rs 5000 if applicable?

As per section 139(4) told that you can file the return for the A.Y. 2008-09 up ro 31st March 2010 but it alsos says that you " MAY " be imposed of penalty of Rs. 5000 . So there may be some imposition OR may not be..................................
But if you not filed the return for A.Y. 2008-09 then as per my opinion you need not to worry & carry on for the A.Y. 2009-10........
