Issue on excess leave during articleship

dear friends ,im in awkward situation

i was on heaven believing that my article is gonna end in Jan 22,2011 anyway,

out of nowhere the sir shows some chart which indicates that i did already take excess leave and as a CPT-PCC batch we are allowed to take 180 days as leave but mine poped up with 204 and telling me that i have to work for him ,well i which i do not wish wont even include in my 10000000000 wish list,

as i studied the leave sheet i found that ,he treated the month of May 2008 as leave ,but actually i was attending ITT training during the month .and he is not even mentioning the days and nights spent on July & September ,October as to complete works

any recommends on wat shall i do ,too desperate need some quality info with provisioning institutes take on matter,

1. If your ITT training was for full day, i.e. during articleship hours, your full day should be counted as working day. If it was for half day, i.e. 3-4 hours clashing with articleship time, and you were at office during other half, you should still get full day counted, if you did not, your half-day should be counted as leave.

My Principal, keeps record for even half-day, if your boss does the same, then above should be followed.

In the above regulation, it allows period of attendance for ITT as period of serving.

 

2. Regarding excess leave, in usual practise you have to re-register the articles and serve the excess leave period (not necessarily under same Principal). But what do you mean by work?? Work as employee? or, re-register as article?

If you mean employee, just get your service completion certificate signed (with actual leave as per his records) and ditch him if you want to, and serve excess leave period under some other CA. It may be possible that your CA may issue certificate with less leave, and may ask you to work out-of-record as article (reducing paper work of re-registration) and/ or continue as employee. There is no legal obligation here, unless you sign something, but you can still claim you were under undue influence. If he signs with less leave, it's his dumbness, still ditch him.. ;) He will be careful from next time with other articles.. :p Pity on others..

 

If you mean re-registration, you can re-register and work for another 24 days under him or if you can find some other CA who can manage with this clause.

 

Or, try to talk with him pointing the rules, remind the over-time worked and request him to adjust with the excess leave. Else if he is a dictator (the general case with CAs) follow the above course of action.

yeah he is a hitler anyway! no offence and none taken!

he was arguing that the ITT training wont be considered as a part of A'ship,and i didnt had the ground of info to prove him otherways,

and and yeah i attended on half days like for 10 days later didnt show up since i cudnt manage both (frankly did ,bud didnt want to show up in office) during ITT ,

and im stillnot sure which option to take!

let me have a talk with him first,

really sometimes need to forget ethics

Got one more doubt,

if we did had a fight wat are the odds he got against ,like if someone called to refer us(Job refer),a bad reply or anything else!

I suggest you to not piss him off, he might be badly pissed if you prove him wrong, he might not even listen to you when you start stating your problem, saying he is busy and ask to come some other time. Well, he will always be busy..

 

Regarding cross verification with Boss for your job applications with other organisation, it all depends on your boss. CAs are pretty egoistical, you see. I say don't get into a fight, try to sort it peacefully even if you have to spare another 1-2 month of your life.

 

Be diplomatic mate, make a pitiable image of yours in front of him. Throw your egos and anger out.

 

And. don't forget your ethics, keep your image clean, it helps.

i was even thinking abt even an assassination (not in real,police just kidding)

well thats some mature suggetion i never gave thought for that part,

my only sad feeling is im wasting my time for someone who never give a sh*t ,forget my lang,

for wat we do! ,just sarcasm to everyone!

Well my friend, if you ever go to some grocery shops, small hotels (for tea, coffee), daily wage labouters, you might find people/ young adults/ maybe kids working for barely 2-3k a month and getting bad treatment like articles (or even worse), they have to work 11-12 hours, they can't go anywhere else, no home, there is no service completion, and no hopes of getting good pay packages later on.

 

Atleast for us it ends someday, for some if never does.. See that, try to be content, and make lives of people around you better.

 

A lot of heroes go unsung who have directly/ indirectly contibuted in your life - freedom fighters/ army men.. That's life. With articleship, neki kar kuen me daal..  10 years down the line, articleship would be just a phase of your life, like puberty.. ;) 

 

Anyhow, compare yourself before articleship and now, has there been any change in personality, outlook towards world? Anything good?

 

BTW, Assassination is a better idea than taking these rules to your boss.. ;)

 

And hey, if your ITT hours were during non-working hours, you might not be getting any considerations for that. That's why I intentionally took time which was during working hours.

yeah,there are things  i loved abt this whole A'ship  the contacts,friends i made during the period and its true that perspects about business world is all changed ,

i did this right was my school,so it was pretty unacceptable at first ,

like in books Ram,Rahim,& Ron started business ha ha ha fun time with accouting!

later start to learn how this whole thing works,

and its touching that u told abt the kids,

and someday dude we all gonna do something abt it,

but now on the belief that,

to help the poor,first thing u should do is dont become one of them"

Yeah, lol ^^. But unless you go through the situation like them, you can't really understand their problem.

 

So, no matter what if one doesn't care for your inputs, you got nice experiences, don't ya? Of course, it could have been better.

 

To avoid becoming a poor is now on you.. ;) Managing with peanuts as stipend must have a made you  good with money management, ain't it? I've become a bl**dy hell miser. lol.

HAHAHA! LOL ^^^.. same here, a lot of times I skip buying in consideration of confusion.

 

My non-CA-student friends make fun of me for my miserness, can't really make them understand, can we?

I jst wanna know in case of transfer  can the excess leave taken in articleship under previous employer  be adjusted in the leave taken in balance period served under present employer during completion

hey i hv my articleship completed as on 24 july 2011...... bt i hv an excess leave of 150 days of my past employer....

i hv to fill 107 and 108 wit present employer... so i want to know whether i hv 2 show my excess leave of d past employer

in dis form 107 or not??? as in 107 it is mentioned dat excess leave taken dan permissible in d said period......

said period means d period i served under present employer??? so how shud i show excess leav of past emplyer in dis

form 107 wit my present employer???

plssssss help........plssssss.....
