our company gave incentive of year 2007-08 of to an employee in 2009-10 after resigned in 2008-09. So should our co. give him Form 16 for 2009-10. we have not deducted any TDS & he has not enquire for such form16.

It is mandatory to issue Form 16 when tax is deducted. Else it is optional. Please understand that Form 16 is a TDS certificate, not a salary certificate.

Agree with Mr Nayak. FORM 16 needs to be issued, in case TDS is dedcuted. Otherwise, if the employee demands, then only you need to give Form 16.
