It can not be said that whenever payment is made by piece rate, there is no relationship of employer and the employee. Taking into account factors like element of control, supervision etc you have to decide if there is a relationship of employer and employee or principal and independent contractor.
Explanation to section 80JJA A explains that the word "workman" shall have the meaning assigned to it in clause (s) of section 2 of the Industrial Disputes Act, 1947. Please refer to this section and also to the judgement of Supreme Court in Shining Tailors vs Industrial Tribunal II UP -AIR 1984 SC 23, 1983 LablC 1509, (1983) IILLJ 413 SC where it was held that piece rated tailors working in big tailoring establishment are workmen
