Is tds applicable?

We have a client providing consultancy services and they have taken website designing services from a company in FY 2012-13 for Rs. 34000.

They do not possess TAN.

So is our client liable to deduct tax at source.and aquire TAN

PS: the payment has to be made within two days

You have not mentioned about the constitution of your client, if it is an individual or HUF which is not liable for tax audit u/s 44AB of income tax act, 1961 in A.Y. 2012-13 than there is no need to deduct TDS, in any other case you can apply for TAN and make payment to client after deducting TDS and dposit the deducted TDS after you are alloted TAN.
Normally you will be alloted TAN within 10 days of application and you can deposit the TDS on due date.
