Assessee has to claim tax refund for AY 2013-14 but assessee failed to file ITR for AY 2012-13, can he file time bared return now?

theoritically return cant be filed now. but 2 days ago i saw on incometax efiling website that the are still giving link for online filing of itr 1 & 4s for ay 12-13. so you can also give it a try.
another option and the best option in your case is to contact your AO and ask him to issue notice u/s 142(1)(i). and then you can file your return in response to such notice.
