Is eway bill mandatory for this invoice

Customer picks up the material valued more than 50000 from the supplier office himself, as per gst number provided by the customer, it is an interstate sale, customer denies to take eway bill as the product is small in size and he can carry it in his car, supplier upload the invoice on gst portal but does not create the eway bill, is there any penalty on supplier.
