Dear Shivam
The question being asked is for F. Y. 2008 - 09 relevant to A. Y. 2009 - 10 whose due date was 31st July, 2009 and not 05th August, 2010. Actually it was 04th August, 2010 for A. Y. 2010 - 11 and not A. Y. 2009 - 10.
Dear Krishna
Penalty upto Rs. 5,000/- can be levied by the A. O. u/s 271F.
The return of income will have to filed with your normal Income Tax Ward officer and there would not be any interest u/s 234A, 234B or 234C as there is no tax payable and refund of tax is there.

Yes u can file without paying the penalty.
However for the penalty u can always contest that no tax was outstanding and take a lenient view to not to levy penalty if demanded by the A. O.
