Please any one have solution - If in the earlier years , the person was earned salary income , the employer deducted TDS & but not filed the return because lack of knowledge & join the new co. now realise to file the return for earlier years but at this he don't have Form 16, wht will be the solution? if he want to file a Belated return since the IT Dept will not accept the return without Form 16 & Earlier co. refuse to give.

your client write the letters to concerned ITO regarding non issuing of FORM NO.16 towards directing to company.

But the co. may defend that the Form 16 has already been issued to the employee, & employee have misplaced that.
