26 January 2011As I am deducted for the person whose payment in year not crossed the limit ie(30000 for professional) and not paid the deducted amount ,can I claim that expenses as deduction in the computation of income on the ground that I am not liable to deduct tax or otherwise its not deductible ? please clarify

tds u/s- 194J is rs. 20,000/- up to 30.06.2010. & from 01.07.2010 rs.30,000/- if u unnecessarly deduct tax after 01.07.2010 even that amount does not exceed rs.30,000 then it must be paid to department and u can't claim deduction untill u pay the same to department, bcause u deduct the tds from the payment.
