Dear Sirs

In our case we have a teacher in school who had received pension of Rs .218000 from govt. in addition to salary paid by us. Salary paid by us amounted to Rs. 180000 after deductions. Govt does not deduct TDS on the said 218000. Whether we are required to deduct tax on amount including 218000 in the head salary .If there any problem on deducting Tax from pension received from govt. If there any problem in showing pension amount in Form 16 issued by us

If the employee makes any declaration to the current employer of any other sums received from the previous employer, then the current employer is bound to make TDS on the whole amount.  In your case you will be requried to make TDS on the pension amount as well as the salary received.

However if the employee doesn;t make any declataion about his previous income, then the current employer is not bound to make TDS.  Then the employee while filing his return of income, will be requried to pay self-assessement tax, if any tax laibiloity arises.
