I am facing problem with this question when my friend ask me that he is taxable salary approx 8 lac and deduct TDS on his salary after due date he is now penalise with 5000 late fee now he saying if I not file return for that financial year then what will happen?

He will be issued notice for not filling return, when TDS has already been deducted.
Advice to file return even with late fees, to save from intrrogation and penalty.
