HRA with rent receipt for joint ownership flat

I own a flat in Hyderabad in which my mother is a co-owner. I am currently residing in this flat.

My query is can i claim HRA with rent receipt benefit from my company if i pay rent to my mother and show the rent receipt for her part of share in the flat. My mother doesn't reside with me.

If you are residing in a house owned by your parents and you are paying rent to them, technically, they are the landlords. You could, thus, claim an exemption, provided they show the same transaction in their income tax returns.

 The house is co-owned by me and my mother and i am residing in this house but my mother is not residing with me. Can i pay rent to my mother in this scenario where  she is a partial owner. Can i pay rent for  her share in the house which she will show in her return . Can i  take a rent receipt for this transaction from my mother and show the same to my Disbursement officer for claiming HRA with rent receipt exemption in income tax.

As u mention that u and ur mom are co-owner and she allowed u to use whole house  as urs.

then u can take ur mom's portion on rent from her.

U can claim this rent receipt for the purpose of claiming HRA exemption.

Thanks a lot CA ankur but my HR at office is not getting convinced he says since i own the flat and living in it i cannot claim HRA wirh rent receipt, is there a section in income tax rules which clearly states HRA status in case of joint ownerships.Since my company is a PSU, HR's here are particularly fussy about minor details due to internal audits.
