as per my view he will not be able to claim deduction for HRA as there is no such provision and if there no such provision we have to give strict reading to it and thus no dedcan be claimed

as per income tax act no HRA is not allowed in this case as HRA is provided by employer to employee.

no assessee cannot claim any deduction in the case where he /she pays rent to his/her spouse provided the house is in the name of spouse. where assessee works.

no, the assessee can't claim deduction, bcoz he paid the rent to his spouse, thus he doesn't bear the expense of rent actually.

If the assessee has the proof of the rent paid i.e. the rent slips and the rent s paid via A/c payee cheque then?

no ,,, the assessee can't claim .... as the HRA is paid by employer to employe ....
