Hra claim

Tax queries 800 views 4 replies

Hi,

I resigned from company A in May 2012 and joining company B in July 2012.
I am living on rent and was unable to claim HRA for April-June from employer A.

My questions are:
1. Can I submit HRA claim for April-June to employer B ?
2. If not, what are my options to claim HRA for April-June timeframe?

Thanks.

Yes, you can show your claim of exemption from HRA to your current employer. Accordingly TDS would be made by the current employer on the total income.

Else while filing the return you can show your claim for HRA & claim the excess TDS made by wasy of refund.

So I assume that when I declare my income frm previous employment I can indicate HRA exemption? Is there any specific format/form to indicate HRA from old employer to the new employer? The reason being the income certificate issued by previous employer would not have HRA claim.

You shud declare your HRA details to yoru previous employer.  On that basis he will accordingly issue Form16 with computation of HRA benfit.

However if your saalry was below taxable limit,  then you can get certified the HRA calculation from yoru previous employer & submit the same to the current employer.

Thanks Giridhar.

The previous employer has already issued the Form16 and is unwilling to modify it. The salary is below taxable limit but the employer is unwilling to certify any HRA calc now. In this case, how should I go ahead? Since the current employer is considering the income from old employer, is it possible for the new employer to consider the HRA claim for the previous income (since its the same financial year)?

Requesting your expert opinion.

Thanks
