how can i claim stamp duty

my wife purchased a house in her name and paid 40000 as stamp duty. can she file ITR and claim this amount? she is just a house
wife.

if she files return every year then she can claim. stamp duty is allowed u/s 80 c

till now she didn't file. this is the first time. can she claim

yes if she has source of income. then she can claim
