Dear Kaya ! nice question asked there ! well i will say if u will read the prospectus of training and training guide u will come to know that an article student can take leave from his principal at maximum of one 6th of whole period else depend on the mutual interest of both there is not a list of particulars holidays so it depends upon the mutual trust of ur and ur principal ! well one thing that i want to ask to u ! is this relates to ur personal training or u r asking for knwldge purpose ?

Look holidays like 15 august, diwali, 1st january are always off. but there is problem on others like Rakhi, Children day, vishkarma day. some CAs dont close office on these days and we have to go. even on some bank holidays are office is not closed. list of holidays is not mentioned. there should be list of holidays for CAs also.
And for articles these holidays should be additional to 1/6th which we are eligible already.

U can take holiday from 15 Aug it will be good. And u can revise your syllibus very easy.......... Your principal ( CA MEMBER ) if give permission according to earlier leave whatever u have taken based on that he ll calculate and he ll give leave............................................

The draft is very wague. It doesnt tell that you are eligible for leave on public holidays etc. It only states that
1. No candidate shall work more than 35 hours per week. If you have worked more than 35 hours in a week(say 45 hrs), then you can claim excess hours (10 hrs) as leave to be set off.
2. In addition to the above, you are entitled to leave for 1/6 of the number of days worked or 2 months whichever is less
Ex : you have worked for 601 days. {(365-52)*2}-25days leave. then calculate
a. 1/6 of 601 = 100 days OR
b. 2 months whichever is less.

hi,as u asked ,what r the allowable leave that principal should give to the article ? this being a nice ques. but ur principal would not like to permit leave of even one hours.......as no benifit for him!
what being the rule is that , u r allwed leave @ 1/6 of the period served by u and this is ur right,our institute has permitted this.
but as u want extra leave like festivleleave etc. this depends upon the discretion of the principal,otherwise ur article.period'll be extend by the extra leave.

I think, all the fellow members have already answered correctly, except Sandeep (as he's misinterpreted the Q allsoever)...
Nywz, as earlier told, u r allowed for 1/6th period of ur articleship to be on an official leave..
Now, this 1/6th definately excludes government or even festival holidays for sure.., and as GAURAV said, there's no fixed pattern of holidays for certain festivals.. But yes, 15/08 & 26/01 are the declared holidays for whole of the nation (ac. to the indian constitution, and also ICAI norms says),, so thats obvious that they can't be asked for even..
I think, u want to ask, that such festival holidays should be counted in ur LEGAL LEAVE OF 1/6TH PERIOD... Then, i wud say "NO".... They are not to be considered in that.. As, these leaves are on PRINCIPAL's own personal norms..

Moreover, we INDIANS have so many festivals, that even our principals do get frustrated of closing out the office for so many days...
Various principals do give the holidays according to their conveynence on festivals.. and vice-versa..
Due to this, some articles may get more no. of festive holidays and some may not..
So, these holidays should not be included in that Legal one...

Final Verdict, ICAI (as to my knowledge) guides its members to grant 1/6th period of articleship, 15/08, 26/01 as holidays.
Moreover, major festivals like DIWALI, HOLI, EID, RAKSHABANDHAN should be allowed, but i don't know anyhting abt that.

As per my opnion that :--------
15 Augest is National Holiday
so there is no question about ICAI guidline
it should be compulsory leave & shoud be given by CA

i think he shud give leave only 4 major occassion like Deewali, Holi, Eid, CHRISMUS ALSO, Rakhi......n sm more which is important..... bt not 4 all d occassion bcoz in india every day is any festival....
so he shud consider only mejor occassion...
thats it...
