I received some kind of service frm CA , he issue me the invoice & charge service tax on that. At the time making the payment to him , whether i deduct TDS on Gross amount or after deduting service tax element on it..

You will have to deduct TDS on the bill amount INCULSIVE of service Tax. Only in case of Rent, such exemption is provided by CBDT through a circular. In all other cases TDS is to be deducted on the value after service tax.

TDS is deducted on gross amount (including service tax), except in case of Rent.
CIRCULAR NO. 4/2008, DATED 28-4-2008. The Central Board of Direct Taxes has through this circular has clarified that tax deduction atsource (TDS) under sections 194-I of Income-tax Act would be required to be made on the amount of rent paid/payable without including the service tax.
