whether penalty is leviable when gstr-3b has been submitted but not filed?

Reacently the Govt has waived off the penalty for late filing of GSTR-3B for July and Aug month.

Yes... I agreed with Mr Vinod Araveti.,
Recently the Late fee not applicable for the GSTR 3B return for the month of August...
In case it's reflect your return then you ll be pay the late fee then it's reverse by CBEC....
